*A new ruling on the [Alien Enemies Act](https://www.archives.gov/milestone-documents/alien-and-sedition-acts) provides a snapshot of the “presumption of regularity” that previous [administration](https://www.whitehouse.gov/administration/)s have enjoyed.*

Sept. 3, 2025, 12:40 PM EDT
By [Jordan Rubin](https://www.msnbc.com/author/jordan-rubin-ncpn1301611)

The [“presumption of regularity”](https://harvardlawreview.org/print/vol-131/the-presumption-of-regularity-in-judicial-review-of-the-executive-branch/) is a boring-sounding but important phrase in the law. It signals the deference that courts have historically given the government. One of the [Trump Justice Department](https://www.msnbc.com/deadline-white-house/deadline-legal-blog/abrego-garcia-returned-contempt-sanctions-trump-admin-still-table-rcna211782)’s latest legal losses highlights how his [DOJ](https://www.justice.gov/) has lost that good faith from the judiciary — or some of the judiciary, anyway.

The latest defeat came [late Tuesday](https://storage.courtlistener.com/recap/gov.uscourts.ca5.224134/gov.uscourts.ca5.224134.507678079.1.pdf) from a divided panel of judges on the [U.S. Court of Appeals for the 5th Circuit](https://www.ca5.uscourts.gov/). The topic was the [Alien Enemies Act](https://www.msnbc.com/deadline-white-house/deadline-legal-blog/trump-alien-enemies-act-memo-deportations-rcna205112), the 18th-century law that [President](https://www.whitehouse.gov/) [Donald Trump](https://www.donaldjtrump.com/) invoked to deport [alleged Venezuelan gang members](https://www.newyorker.com/news/annals-of-immigration/the-makeup-artist-donald-trump-deported-under-the-alien-enemies-act). The panel majority granted [preliminary injunction](https://storage.courtlistener.com/recap/gov.uscourts.ca5.224134/gov.uscourts.ca5.224134.196.0.pdf) against the [administration](https://www.whitehouse.gov/administration/)’s use of the law for deportations in Northern [Texas](https://www.texas.gov/).

The ruling is significant in its own right because it undercuts one of the key legal claims pressed by the government in [Trump](https://www.donaldjtrump.com/)’s second term (a declassified government memo [previously undercut](https://www.nytimes.com/2025/05/05/us/trump-venezuela-gang-ties-spy-memo.html) the factual basis for [Trump](https://www.donaldjtrump.com/)’s invocation as well).

But disagreement between the majority and the dissent also spotlights a broader issue over whether the courts trust [this DOJ](https://www.nytimes.com/2025/08/04/us/politics/trump-justice-department-judges-courts.html), whose representations [judges have questioned](https://www.nytimes.com/2025/08/04/us/politics/trump-justice-department-judges-courts.html) in [multiple cases](https://www.msnbc.com/deadline-white-house/deadline-legal-blog/judge-abrego-garcia-discovery-doj-trump-rcna202351) related to the [administration](https://www.whitehouse.gov/administration/)’s [aggressive deportation agenda](https://www.msnbc.com/deadline-white-house/deadline-legal-blog/judge-boasberg-trump-criminal-contempt-deportation-rcna200064).

In granting the injunction Tuesday, the [5th Circuit](https://www.ca5.uscourts.gov/) majority had to analyze the likelihood that the plaintiffs would suffer irreparable harm without preliminary legal relief. Siding with the plaintiffs, the majority cited (among other things) previous litigation at the [Supreme Court](https://www.supremecourt.gov/) where the justices sided with plaintiffs despite the government’s assurances. The two judges in the majority on the [5th Circuit](https://www.ca5.uscourts.gov/) panel were [George W. Bush](https://georgewbush-whitehouse.archives.gov/) appointee [Leslie Southwick](https://www.fjc.gov/history/judges/southwick-leslie) and [Joe Biden](https://bidenwhitehouse.archives.gov/) appointee [Irma Ramirez](https://www.fjc.gov/history/judges/ramirez-irma-carrillo).

In a lengthy dissent, [Trump](https://www.donaldjtrump.com/) appointee [Andrew Oldham](https://www.fjc.gov/history/judges/oldham-andrew-stephen) was bothered by (among other things) the majority refusing to give greater deference to the government. More dramatically, [Oldham](https://www.fjc.gov/history/judges/oldham-andrew-stephen) accused the majority of suggesting that [DOJ](https://www.justice.gov/) lawyers are lying. “If they are, I suppose they should be sanctioned. But it is astounding to say that lawyers from the United States [Department of Justice](https://www.justice.gov/) are lying,” wrote the judge, [who’s a contender](https://www.abajournal.com/news/article/three-potential-scotus-picks-top-the-ranks-in-a-trump-alignment-index) for any [Supreme Court](https://www.supremecourt.gov/) vacancy that emerges under [Trump](https://www.donaldjtrump.com/).

“The majority’s disbelief of [DOJ](https://www.justice.gov/) also conflicts with the presumption of regularity,” [Oldham](https://www.fjc.gov/history/judges/oldham-andrew-stephen) went on, writing that courts “employ a heavy presumption that Government officers, including Government lawyers, act in good faith ‘in the absence of clear evidence to the contrary.’” He found it “troubling that, here again, the rules for this [Administration](https://www.whitehouse.gov/administration/) are different.” If anything, he concluded, “the majority seems to give this [President](https://www.whitehouse.gov/) a presumption of irregularity.”

[Oldham](https://www.fjc.gov/history/judges/oldham-andrew-stephen)’s complaint calls to mind [Supreme Court](https://www.supremecourt.gov/) Justice [Ketanji Brown Jackson](https://www.msnbc.com/deadline-white-house/deadline-legal-blog/supreme-court-ketanji-brown-jackson-dissent-deadline-newsletter-rcna214180)’s recent complaint that her colleagues invariably find a way to side with the [administration](https://www.whitehouse.gov/administration/), [lamenting that](https://www.msnbc.com/deadline-white-house/deadline-legal-blog/ketanji-brown-jackson-supreme-court-trump-calvinball-rcna226523) the high court is [playing a version of “Calvinball” in which “this Administration always wins.”]({% link _posts/2025/08/2025-08-23-JusticeJacksomReferencesCalviball.md %})

If this latest [Alien Enemies Act](https://www.archives.gov/milestone-documents/alien-and-sedition-acts) litigation makes it to the justices, it can provide the latest test of whether [Oldham](https://www.fjc.gov/history/judges/oldham-andrew-stephen)’s or Jackson’s views are vindicated.

*As the two conservative news networks battle for views, [Newsmin](https://www.newsmax.com/) claims [Faux News](https://www.foxnews.com/) is trying to monopolize the market.*

Sept. 3, 2025, 5:15 PM EDT
By Erum Salam

[Newsmin](https://www.newsmax.com/) sued fellow-conservative network [Faux News](https://www.foxnews.com/) in federal court on Wednesday, alleging “unlawful monopolization of the Right-leaning Pay TV News Market.”

The [complaint](https://www.bloomberglaw.com/public/desktop/document/NewsMaxBroadcastingLLCvFoxCorporationetalDocketNo925cv81091SDFlaS?doc_id=X5Q2BN3BCG88UCBNBJQS70CPHED), filed in the [U.S. District Court for the Southern District of Florida](https://www.flsd.uscourts.gov/), says that the “Faux Corporation has long engaged in an exclusionary scheme to increase and maintain its dominance in the market for U.S. right-leaning pay TV news, resulting in suppression of competition in that market that harms consumers, competition, and [Newsmin Broadcasting](https://www.newsmax.com/).”

[Newsmin](https://www.newsmax.com/) claims [Faux News](https://www.foxnews.com/) — the network famous for shows such as ["Jesse Watters Primetime,"](https://www.foxnews.com/shows/jesse-watters-primetime) ["Hannity"](https://www.foxnews.com/shows/hannity) and ["The Five"](https://www.foxnews.com/shows/the-five) — employs specific tactics to stifle competition, including imposing financial penalties on distributors for carrying other networks such as [Newsmin](https://www.newsmax.com/) and creating contractual barriers that purposefully exclude [Newsmin](https://www.newsmax.com/).

[Newsmin](https://www.newsmax.com/) claims that were it not for [Faux](https://www.foxnews.com/)’s practices, “[Newsmin](https://www.newsmax.com/) would have achieved greater pay TV distribution, seen its audience and ratings grow sooner, gained earlier ‘critical mass’ for major advertisers and become, overall, a more valuable media property.”

The conservative news channel market has been dominated by [Faux News](https://www.foxnews.com/) for decades. But [Newsmin](https://www.newsmax.com/), founded as a website in 1998 and later as a TV channel in 2014, as well as newer networks like [Once Again, Not News (OANN)](https://www.oann.com/)), which launched in 2013, have created more competition for the powerhouse among conservative viewers.

[Faux News](https://www.foxnews.com/) [averages roughly 3 million total prime-time viewers](https://www.adweek.com/tvnewser/here-are-the-cable-news-ratings-for-may-2025/), making it the most-watched cable news network. By contrast, [Newsmin](https://www.newsmax.com/) averages less than 300,000 prime-time viewers.

[Faux News](https://www.foxnews.com/) did not immediately respond to [MSNBC](https://www.msnbc.com/)’s request for comment, but [in a statement to Variety](https://variety.com/2025/tv/news/newsmax-sues-fox-news-antitrust-dominance-right-leaning-pay-tv-news-1236506268/), a [Faux News Media](https://www.foxnews.com/) spokesperson said: “[Newsmin](https://www.newsmax.com/) cannot sue their way out of their own competitive failures in the marketplace to chase headlines simply because they can’t attract viewers.”

*"We are here today, and we are speaking, and we are not going to stop speaking,” said one survivor.*

Sept. 4, 2025, 1:54 PM EDT
By Mimi Rocah, former district attorney of Westchester County, New York

An extraordinary thing happened Wednesday morning on Capitol Hill: Survivors of the [sexual abuse, trafficking and anguish](https://www.justice.gov/usao-sdny/pr/ghislaine-maxwell-sentenced-20-years-prison-conspiring-jeffrey-epstein-sexually-abuse) perpetrated by [Jeffrey Epstein](https://www.msnbc.com/top-stories/latest/epstein-trump-wall-street-journal-letter-rcna219501) and [Ghislane Maxwell](https://www.msnbc.com/the-weeknight/watch/top-dem-survivors-disgusted-by-ghislaine-maxwell-s-special-treatment-call-her-a-monster-246638661751) over two decades [finally had their voices heard](https://www.msnbc.com/ana-cabrera-reports/watch/epstein-survivors-lawmakers-speak-on-capitol-hill-246547525915).

“I have to use my voice, the voice that had been silenced by fear and shame for so many years,” said survivor Anouska de Georgiu. Another survivor, Marina Lacerda, spoke publicly for the first time. “Our government could have saved so many women, but Jeffrey Epstein was too important and those women didn’t matter,” [Lacerda said](https://www.cbsnews.com/live-updates/jeffrey-epstein-victims-news-conference-capitol-hill/?). “Well, we matter now. We are here today, and we are speaking, and we are not going to stop speaking.”

> *The voice of one person coming forward can spur more to come forward.*

The survivors made their remarks at a nonpartisan rally hosted by [World Without Exploitation](https://www.worldwithoutexploitation.org/), an anti-trafficking organization. That was followed by a news conference by a [bipartisan group of House representatives](https://www.house.gov/), with both events played live across major broadcast networks. The purpose was to pressure politicians to back the release of all the files in the government’s investigations of Epstein from the [Justice Department](https://www.justice.gov/) and other agencies.

But Wednesday was so much more than a political event. It was a coming together of women and their families who have been repeatedly dismissed, ignored and lied to over decades by [a government and justice system](https://www.msnbc.com/the-weeknight/watch/top-dem-survivors-disgusted-by-ghislaine-maxwell-s-special-treatment-call-her-a-monster-246638661751) that should have protected them. According to [Lauren Hersh](https://www.worldwithoutexploitation.org/bios/lauren-hersh), [World Without Exploitation](https://www.worldwithoutexploitation.org/)’s executive director, some survivors in attendance felt this was the first time they could talk about being exploited by Epstein. As [survivor Liz Stein said](https://19thnews.org/2025/09/epstein-survivors-justice-capitol-trump/), “We’re in a sorority that none of us asked to join, but we all stand here today, stronger together, because our collective voice is powerful.”

I saw Wednesday the same phenomenon I saw in the 20 years I was a federal and state prosecutor working with victims of abuse: The voice of one person coming forward can spur more to come forward. There is strength and safety in numbers that these women and their families have found. It helps survivors understand and internalize that it is not their fault and they are not alone. You could hear it in their cheers at calls of [“no more”](https://www.instagram.com/reel/[DOJ](https://www.justice.gov/)pz18jX-x/?igsh=N3NrOTJscWZtMW8z) and see it in their supportive hugs and tears for one another. Their mission is not only to demand that the files in the government’s possession be released so that they can learn what is known about the abuse they suffered, but also more broadly to ask that Americans wake up to the alarming statistics about the sexual abuse of minors that prosecutors like me are all too familiar with.

This demonstration of [political](https://www.youtube.com/watch?v=-a1E9KX1O_w) and [personal unity](https://www.instagram.com/reel/[DOJ](https://www.justice.gov/)k2j1CXv7/?) was almost entirely brought on by the actions of the very same people — [Trump](https://www.donaldjtrump.com/) and his allies — who are desperate for the issue to go away. This group of survivors felt demoralized and diminished after then-U.S. Attorney Alex Acosta inexplicably gave Epstein a slap on the wrist in 2008 (Acosta would later serve in the first [Trump](https://www.donaldjtrump.com/) administration). And they have been treated with the same disdain by the current [Justice Department](https://www.justice.gov/).

The only sliver of justice the victims have seen was in 2021, when prosecutors in the [Southern District of New York](https://nysd.uscourts.gov/) [successfully prosecuted Maxwell](https://www.nbcnews.com/news/us-news/ghislaine-maxwell-trial-verdict-reached-ghislaine-maxwell-sex-traffick-rcna9479) on federal sex trafficking charges. Some of the survivors who spoke Wednesday (including de Georgiu) testified in that trial despite their fears. But now [Trump](https://www.donaldjtrump.com/)’s [Justice Department](https://www.justice.gov/) is reversing even that smallest of victories.

> *This is not a hoax. We are real human beings. This is real trauma.”*
Epstein Survivor Haley Robinson

First, the lead prosecutor on the Maxwell team [was abruptly fired](https://www.msnbc.com/top-stories/latest/maurene-comey-firing-letter-colleagues-doj-epstein-diddy-prosecutor-rcna219383) in July. Then [Deputy](https://www.justice.gov/dag/) [Attorney General](https://www.justice.gov/) [Todd Blanche](https://www.justice.gov/dag/) interviewed Maxwell and subsequently published their sit-down, giving her a platform to lie about survivors’ courageous testimony. And [Trump](https://www.donaldjtrump.com/) has not only refused to rule out a pardon for Maxwell; he has defended [his “right to give pardons.”](https://www.nbcnews.com/politics/politics-news/jeffrey-epstein-ghislaine-maxwell-accusers-rcna227334)

On Wednesday, the survivors repeatedly talked about being pushed too many times and too far. Teresa Helm [called Blanche’s interview](https://thehill.com/homenews/administration/5483891-epstein-survivor-blasts-justice-department/) “repulsive” and “triggering,” saying that Maxwell used the same voice for her “lies” in the interview that she did when trapping young women like Helm to join Epstein’s enterprise. Haley Robinson bristled at [Trump](https://www.donaldjtrump.com/)’s repeated labeling of Epstein’s abuse as “a [Democrat](https://www.democrats.org/) hoax,” [stating plainly:](https://www.pbs.org/newshour/politics/watch-the-abuse-was-real-epstein-survivor-implores-trump-who-again-calls-case-a-hoax) “This is not a hoax. We are real human beings. This is real trauma.” Annie Farmer expressed the survivors’ outrage at finding out through press reports that Maxwell had been transferred overnight to a “spa” prison in Texas after her [Justice Department](https://www.justice.gov/) interview.

For years, these survivors have been sidelined and silenced. But the shoves and insults from [Trump](https://www.donaldjtrump.com/) and his [DOJ](https://www.justice.gov/) were the final straw. [As survivor Jess Michaels put it:](https://talkingpointsmemo.com/cafe/there-is-no-hoax-epstein-survivors-go-to-capitol-hill-to-demand-transparency) “What once kept us silent now fuels that fire and the power of our voice. … We are not the footnotes in some infamous predator’s tabloid article. We are the experts and the subjects of this story. We are the proof that fear did not break us.”

*Wednesday’s news conference shows the Epstein story isn’t going anywhere, no matter how badly the [president](https://www.whitehouse.gov/) may want it to.*

Sept. 4, 2025, 2:11 PM EDT
By Chris Hayes

This is an adapted excerpt from the Sept. 3 episode of “All In with Chris Hayes.”

On Wednesday, a bipartisan group of lawmakers and survivors made it clear that, despite [Donald Trump’s](https://www.msnbc.com/donald-trump) demands to the contrary, the Jeffrey Epstein story isn’t going anywhere. In a truly [remarkable scene on Capitol Hill,](https://www.msnbc.com/ana-cabrera-reports/watch/epstein-survivors-lawmakers-speak-on-capitol-hill-246547525915), a group of survivors rallied with members of [Congress](https://www.congress.gov/) to support a [bipartisan discharge petition,](https://www.msnbc.com/top-stories/latest/release-epstein-files-house-gop-massie-khanna-rcna228850), led by [Reps.](https://www.house.gov/) [Ro Khanna (D-CA17)](https://khanna.house.gov/) and [Thomas Massie (T-KY4)](https://massie.house.gov/), that would ensure the release of all Epstein-related documents.

As these survivors were sharing their powerful stories with the world, [Trump](https://www.donaldjtrump.com/) was in the [Oval Office](https://www.whitehouse.gov/) calling it all fake news. The [president](https://www.whitehouse.gov/) once again referred to the scandal as a [“Democrat hoax that never ends.”](https://www.youtube.com/watch?v=oQEHGWudECs)

[Trump](https://www.donaldjtrump.com/) is just so obviously desperate for all of this to go away. He’s [suing The Wall Street Journal](https://www.msnbc.com/rachel-maddow-show/maddowblog/trump-sues-wsj-murdoch-epstein-birthday-letter-rcna219701) for \$10 billion over its reporting of a lewd, innuendo-filled birthday note that the paper reported [Trump](https://www.donaldjtrump.com/) sent to Epstein.

In [Congress](https://www.congress.gov/), his sycophants, including the [speaker of the](speaker.house.gov/) [House](https://www.house.gov/), [Mike Johnson (T-LA4)](https://mikejohnson.house.gov/), held [a closed-door meeting](https://www.politico.com/live-updates/2025/09/03/congress/mike-johnson-thomas-massie-spar-jeffrey-epstein-00541263) in the basement of the Capitol to try and whip votes against the bipartisan petition to release all the files — files, I should note, that have already been vetted by [Trump](https://www.donaldjtrump.com/)’s [Justice Department](https://www.justice.gov/) and, according to [The New York Times](https://www.nytimes.com/2025/07/23/us/politics/trump-epstein-files-named.html), contained the [president](https://www.whitehouse.gov/)’s name. Something he reportedly was made aware of.

> *[Trump](https://www.donaldjtrump.com/) is just so obviously desperate for all of this to go away.*

So, in some ways, it was always fated to come to this. Because there is no position more preposterous on its face than that [Trump](https://www.donaldjtrump.com/) — the guy [seen in a video](https://www.youtube.com/watch?v=pUmdFmAmHoM) leering at women with Epstein, the guy who [went on the record more than 20 years ago](https://nymag.com/nymetro/news/people/n_7912/) about how much Epstein likes young women — was going to be the one to release all of the details about the millionaire, his associates and his crimes and misdeeds.

As one survivor pointed out today, the two did not hide their friendship. “Jeffrey and Ghislaine were always very boastful about their friends, their famous or powerful friends,” Chauntae Davies said. “And his biggest brag forever was that he was very good friends with [Donald Trump](https://www.donaldjtrump.com/). He had an 8-by-10 framed picture of him on his desk with the two of them — like they were very close.”

But the [White House](https://www.whitehouse.gov/) has still tried to argue that [Trump](https://www.donaldjtrump.com/), of all people, would be the sword of justice against the country’s most notorious pedophile and his accomplices.

There’s also the [president](https://www.whitehouse.gov/)’s base, that absolutely believed he would follow through. But when his [administration](https://www.whitehouse.gov/administration/) didn’t, some of those folks who fell for it turned on him. That includes the [podcast bros,](https://www.msnbc.com/top-stories/latest/joe-rogan-hammers-trump-jeffrey-epstein-rcna226387) who were mostly just [Trump](https://www.donaldjtrump.com/)-friendly, but also the real, dyed-in-the-wool MAGA loyalists.

The discharge petition is bipartisan in large part because it’s been signed onto by people like [Reps. Nancy Mace, Marjorie Taylor Greene and Lauren Boebert.](https://www.msnbc.com/all-in/watch/mtg-boebert-mace-to-back-epstein-files-vote-defying-trump-white-house-246487109873) Say what you will about them (and there is a lot to say), but in this one narrow instance, it seems as though they hold enough genuine conviction to buck their dear leader.

[Trump](https://www.donaldjtrump.com/) is going to try to bring the MAGA hammer down on the dissenters. But if Wednesday’s news conference is any indication, this story is not going anywhere, no matter how badly [Trump](https://www.donaldjtrump.com/) may want it to.

He is the editor-at-large at [The Nation](https://www.thenation.com/). A former fellow at [Harvard University](https://www.harvard.edu/)’s [Edmond J.
